NY State Disability Question?
I was injured on the job and am now seeking workers compensation. The accident took place in Oct. of '08 and I have a WC hearing coming up pretty soon. However, right now I should be receiving Disability, but the insurance company cannot begin making payments until my former employer completes their portion of the DB450 claim form. The form was first sent to them at the end of Oct. and the director only answered 3 of the 17 questions (he did not put my wages which is the single most important thing the insurance company needs). I do not wish to have any contact with the employer because they used false allegations to fire me on the day that I asked for the WC forms and I do want my contacting them to be an opportunity to make any more. Is it legal for them not to properly fill out this form? It seems spiteful and wrong. They also never did pay overtime and now it seems as if they have something to hide. Any suggestions>
